Terms and Conditions

Studio and Memberships Policies

1. STUDIO 1.1 STUDIO ETIQUETTE 1. Arrive early for class. No entry to the studio 5 mins after class starts. 2. Always check in on the iPad near reception, to avoid receiving a penalty on your account. 3. No phones in class. 4. It's recommended that you bring a towel if you sweat a lot. 5. Follow the teacher's instructions to stay safe and prevent any injuries in class. 6. Listen to your body for the day. 7. Respect the space and others around you. 8. Be mindful of your volume to avoid disturbing others and to heighten levels of focus. 9. After class, wipe the mat down. 10. Cancel within 6 hours to avoid penalty fines. 11. Have fun, challenge your limits, create balance. 1.2 ROLLING MEMBERSHIP PURCHASE POLICIES By pressing ‘Pay now’ or ‘Book’, you agree to pay the sum per calendar month. The first payment will be taken immediately from your nominated card today on Contract agreement date. Recurring payments will be every month following on the same date. Payments will continue to recur indefinitely until cancelled by agreement between the subscriber and theLodge.space. Payments will be collected by Stripe via Momence. Memberships can be cancelled by providing one calendar month’s notice to hello@thelodge.space. A minimum sign up period of two months is required for all Monthly recurring memberships. Consumer Contract Regulations (2014) Act applies. Under the Consumer Contract Regulations (2014) you are entitled to cancel an unused membership purchase and contract within 14 days from the date of purchase for which you will receive a full refund. Should you have used your membership within the 14 days cooling off period a partial refund will be provided. Any cancellation requests after this date will not be eligible for a refund. Memberships can be paused for a period of up to two months each year, memberships can only be paused for a whole payment cycle, not for shorter periods of time. We understand that you may be unable to attend due to injuries, illness therefore if you have to please let us know and we will temporarily pause your membership. If you have paused membership for a month, and on return of pause, desired termination of membership we still need to receive one month’s notice. No refunds. One month’s notice period can potentially be transferred to treatment booking or friends account under unique circumstances. Please note your membership must run for a full month after pause before it can be cancelled. You are only allowed one late cancellation per month before incurring a late cancellation charge. Late cancel and no show fees will be applied to your account and deducted. These charges will be applied to the credit/ debit card held on file. A late cancellation is any class booking cancelled with less than 6hrs notice before the start of the class. The fee for a late cancellation is £5. Cancellations of classes outside of our late cancellation fee, will be credited to your account and it will not be refunded in monies. A "no show" is any booking that is not attended. The fee for a no show £12. To avoid these please ensure that you cancel any class booking you cannot attend with more than six hours notice. If a card payment fails theLodge.space will get in touch to resolve this. If a card payment failure has not been fixed within 7 days theLodge.space reserves the right to charge a £20 payment failure admin fee suspending your account until payment has been made. Whilst the account is suspended, access to classes will be unavailable. theLodge.space is PCI compliant and every measure is taken to protect your card information. 1.3 NON ROLLING SUBSCRIPTION/PACK PURCHASES Any class cancellations with less than six hour's notice will be classed as a late cancellation and a fee will be charged to the credit or debit card held on file. A late cancellation is any class booking cancelled with less than 6 hrs notice before the start of the class. The fee for a late cancellation is £5. Cancellations of classes outside of our late cancellation fee, will be credited to your account and it will not be refunded in monies. The Lodge Space reserves the right to charge a fee for “no shows”. Intro offer purchases are subject to a no show fee of £12. To avoid these please ensure that you cancel any class booking you cannot attend with more than six hours notice.

Liability Waiver

1.4 LIABILITY WAIVER In signing up to use the facilities at theLodge.space you are accepting personal liability for your own safety and are agreeing that you are fit and well enough to take part in physical exercise. Should you have any concerns about your wellness to attend please consult your Doctor. If you are taking any medication that may impact your ability to participate in class then please also consult your doctor beforehand. By participating in our classes, you understand this produces a risk of injury and accept that you are solely responsible for any injuries sustained in the session. It is your responsibility to listen to your body and use this to inform your decisions. Your participance accepts that you are fully aware of the risks involved. You accept that neither the instructor nor the facility is liable for any injury, or damages, to person or property resulting from the taking of the class. If any movement feels too difficult, too uncomfortable, or too physically challenging for you, please do not continue the movement or class. Always tune into your own physical experience and let this guide your choices throughout your practice. You must advise the instructor at the beginning of each and every class of any injuries, illnesses or issues that may impact your ability to participate. Our classes are not a substitute for physiotherapy or medical care, if you have any serious conditions please inform our teachers first. In classes you may receive physical assists or adjustments from the instructor to enhance and correct body posture, if this is something you are not comfortable with then please inform them beforehand. You must be at least 16 years of age to attend the adult classes at theLodge.space. From the age of 15 and below we have designated classes children can attend. In such classes children are the full responsibility of the parent or guardian. It is strictly forbidden to take part in classes or treatments whilst under the influence of alcohol and recreational drugs. In agreeing to the liability waiver you are also agreeing to our terms and conditions, personal privacy policy, cancellation policy and purchase policy. Your agreement is legally and contractually binding with theLodge.space. 1.5 CHILD BOOKING WAIVER The Lodge Space takes all reasonable care in ensuring that its programmes are safe. However, the Parent and/or Carer agrees that their child will be engaging in physical activities that may involve some risk of injury. The Parent and/or Carer acknowledges that they have been aordvised to consult with their child’s physician with respect to any past or present injury, illness, health problem any other condition or medication that may affect their child’s participation in the The Lodge Space programmes. The Parent and/or Carer assumes the above risks and accepts responsibility for any injury sustained by their child and discharge and hold harmless The Lodge Space, its Owners, and personnel including its Teachers and its Suppliers from any liability arising from any injury to your child or other persons or property caused by your child’s participation in the The Lodge Space programmes. The Lodge Space takes no responsibility whatsoever for any loss, damage or expense incurred by a Pupil and or Parent/Carer whilst participating in a class or whilst on the premises of where a class is taking place. The Lodge Space reserves the right to exclude a Parent and/or Carer and/or Pupil from a class permanently, or for the time they feel necessary, due to behaviour that is not deemed acceptable within a class. The Parent and/or Carer agrees that any claim made against The Lodge Space, its Owners, and personnel including its Teachers and its Suppliers, will be made in writing within 30 days of the incident taking place and failure to report in writing within this time will negate any such claim. The Parent and/or Carer and/or Pupil must not attend any Class whilst suffering from any serious illness or contagious disease or anything similar thereto. The Parent and/or Carer takes full responsibility for the Pupil during a class and/or whilst on the premises for a class. Our yoga is fun but it may be physically challenging and carry with it risks that we cannot entirely eliminate. These include the risk of personal injury. You should not practice our yoga unless you are fit and healthy to do so. We are not qualified to express an opinion that you are fit and healthy to practice yoga. You may wish to obtain professional or specialist advice from your doctor before practicing yoga. You are solely responsible for your health and safety while practicing yoga including for the health and safety of any child taking part. These terms and conditions constitute the entire agreement between the parties hereto and supersedes prior agreements and understandings between the parties.

Treatments & Hire Policies

2. TREATMENTS 2.1 TREATMENT POLICY The services offered are not a substitute for medical care. Any pain or discomfort during the treatment, you will immediately inform your therapist. You agree not to hold the therapist responsible for any pain or discomfort during or after the session. 2.2 CANCELLATION POLICY By clicking ‘Pay now’ or ‘Book’, your payment is non-refundable within 24 hours notice of cancellation. Cancellations of 24 hours or more will be refunded as a credit to your account, not in monies. Further charges may be due if you arrive late or add an extension. By signing you accept these terms. 3. HIRES 3.1 HIRE INFORMATION These terms and conditions are set out for all individuals and companies hiring any facility at theLodge.space. The rental dates and times will be confirmed and agreed by email between the parties which is to be recognized in conjunction with this document. If booking manually through the studio, a 50% non-refundable deposit for hires amounting to a total cost of £50 and over. Costs of booking online are non-refundable, but can be moved if notified within 2 weeks of the event. For bookings with a deposit, the remaining amount will be settled on arrival at Reception on the day of your event. This can be paid in The Lodge Space via Card at reception. Any manual booking with no deposit will not be confirmed and therefore the space may be hired out by someone able to pay the deposit. The hiree is responsible for their guests during the hire of the studio. It is important that the hiree ensures the facilities provided are fit for the purpose of their booking. You are required to ensure that all fixtures, fittings and equipment are used correctly and that no damage occurs. theLodge.space reserves the right to charge for the replacement of any equipment or property damaged or broken during the hire period. There is no parking available on site for guests. One car space can be made available if the hiree has heavy equipment to unload and submits a request ahead of their event with the Event Manager. 3.2 CANCELLATION POLICY We ask that you give us as much notice as possible to cancel a hire, the deposit is non-refundable. theLodge.space reserve the right to cancel the hire at any time should the partner’s activities be deemed inappropriate, a danger to the public, or a risk to the business. In the event of the studio being required, TheLodge.space reserves the right to cancel any hire bookings with a minimum of 14 days notice. theLodge.space reserve the right to change the hire fees with a month's notice. theLodge.space reserves the right to amend your booking should it clash with another. Hire time period Hirees have 15 minutes either side of their booking complimentary for any set up and breakdown, in this time the space may be shared by the following or previous booking. If the hiree requires longer than 15 minutes to set up, then this will have to be included in their booking time. The hiree must comply with the hire times and ensure to vacate the studio by the agreed time as there may be another booking or a timetabled class immediately afterwards. If the booking does overrun, payment is required at the regular studio hire rate. The hiree is responsible for leaving the studio clean and tidy. Any yoga/fitness equipment used must be tidied away. Mops and cleaning equipment can be found at reception if necessary. The hiree should report any concerns or damages to Reception immediately. Publication TheLodge.space | www.thelodge.space | events@thelodge.space As part of your event publication, any mention of theLodge.space in the public domain (i.e. on social media sites and advertising material) should be positive and non-derogatory. Any photos or media taken within theLodge.space and used in the public domain must mention/tag theLodge.space. TheLodge.space cannot guarantee any support with event promotion unless separately arranged with the Marketing Team. Any agreements will be confirmed by email between the Marketing Team and the hiree. Catering Food should not be consumed in the studio. Food from outside may not be consumed on premises. We recommend pre-ordering food for big group bookings, to ensure that food is served at once. If no catering is arranged for your booking café seating is not guaranteed. If you wish to arrange catering please email events@thelodge.space Health & Safety The hiree is responsible to ensure they hold indemnity insurance and any other insurance/ qualifications that their industry/activity requires. The hiree should not tamper with any furnishings, electrical settings and equipment without written agreement from the Management Team at theLodge.space. The hiree should not take any action that may breach the health and safety rules of theLodge.space. The hiree is responsible for the health and safety of their own students/participants. In the event of an accident there is a first aid box and accident reporting book available at Reception. For Health and Safety reasons, drinking glasses are not allowed in the studio. Drinks in plastic are permitted. theLodge.space is strictly no smoking throughout the premises, including the private courtyard. theLodge.space encourages an inclusive, friendly environment. All employees, partners and members of theLodge.space should be treated with respect. Verbal or physical abuse of any kind is not tolerated.

Privacy Policy

PRIVACY POLICY Your privacy is important to us. We only collate and use data on your individual person that is deemed essential for the operation of your membership or use of the facilities at theLodge.space. Your personal information will be stored securely in line with GDPR requirements. We will not share your personal information to any third party companies other than those used for the operation of your membership. At present we use BSPORT for the management of your memberships and class/ therapy bookings. You have the right to “opt in” to decide to receive marketing communications from us which will include our newsletter providing offers, updates, and news. We recommend that you “opt in” when signing up to our services to ensure that you receive these essential communications. Essential communications regarding the operation of your account such as payment receipts and booking confirmations are mandatory and will be sent by email or text (in line with your set preferences). Should you ever stop using our facilities at theLodge.space and wish to have your personal information removed from our records please do not hesitate to ask by emailing us at hello@thelodge.space. If you continue to use our facilities after making this request please note that we will be required to hold specific and limited personal information to be able to provide the relevant service in line with Health & Safety & Data Protection Laws. Should you ever wish to access the personal data we hold for you please get in touch with us on hello@thelodge.space and title your request “Subject Access Request.” Under the new GDPR rules we will provide you with a summary of your personal data within 40 days. Please note that we cannot provide information for any other individuals other than yourself.
